Terms of Service

1. Acceptance of Terms

By accessing or using this website and booking photography services from Pixels, you agree to be bound by these Terms of Service. If you do not agree, please discontinue use of our website and services.

If photography services are arranged through a school, district, athletic program, or organization, additional agreements may apply.

2. Services Provided

We provide professional photography services including:

• School      portraits (individual, sibling, and class photos)
• Sports team and      individual athlete photography
• Event      photography
• Digital image      downloads
• Print products      and specialty photo items

Services may be delivered in partnership with schools, districts, leagues, or other youth organizations.

3. Booking and Payment

3.1 Booking

Sessions may be scheduled:

• Directly by      parents/guardians
• Through a      school or sports organization
• Via online      booking platforms
• Contacting our      office

3.2 Payment

• Payment is due      at the time of order unless otherwise stated.
• Digital      downloads must be paid in full prior to access.
• We reserve the      right to adjust pricing prior to order confirmation.

3.3 Refunds

Due to the custom nature of photography products:

• All print and      digital sales are final.
• Retakes may be      offered in cases of photographer error.
• Refunds will      not be issued for dissatisfaction related to facial expressions, poses,      uniforms, or participant cooperation.

4. Copyright and Ownership

All images are the exclusive intellectual property of Pixels and are protected by copyright law.

We always retain full ownership of all images.

No copyright ownership is transferred to clients unless explicitly stated in writing.

5. Digital Download License Agreement

Upon purchase of a digital image, clients are granted a limited, non-exclusive, non-transferable personal-use license subject to the following terms:

5.1 Permitted Uses

The purchaser may:

• Download and      store the image for personal use
• Print the image      for personal display
• Share the image      on personal social media accounts
• Share with      family members for personal use

5.2 Prohibited Uses

The purchaser may NOT:

• Sell, license,      or redistribute the image
• Use the image      for commercial purposes
• Submit the      image to contests without written permission
• Edit, alter,      apply filters, or manipulate the image
• Remove      watermarks (if applicable)
• Use the image      for advertising, business branding, or promotional materials

5.3 Social Media Use

When sharing online:

• The image may      not be altered.
• Credit to Pixels      is appreciated.
• Images may not      be downloaded from online galleries via screenshot or unauthorized      methods.

5.4 License Termination

Violation of this license automatically terminates the user’s rights to use the image and may result in legal action.

6. Model Release and Promotional Use

By participating in a photography session, clients (or parents/guardians of minors) grant permission for images to be used for:

• Portfolio      display
• Website and      social media promotion
• Studio samples
• Marketing      materials

If you wish to opt out, written notice must be submitted prior to the photography session.

For school or league events, promotional consent may be governed by agreements with the organization.

7. Minor Participants and Parental Consent

For individuals under 18 years of age:

• A parent or      legal guardian must provide consent.
• Schools or      athletic organizations shall be responsible for consent on our behalf.
• We photograph      minors in group or organized settings only.

We do not identify minors by full name publicly without expressing written parental consent.

8. Student Data Security and Privacy Protection

We recognize the sensitive nature of student information and implement reasonable administrative, technical, and physical safeguards to protect personal data.

8.1 Information We May Collect

• Student name
• Grade level
• School name
• Team      affiliation
• Parent/guardian      contact information
• Order history
• Payment      information (processed securely through third-party processors)

We collect only the minimum necessary data required to fulfill photography services.

8.2 Data Security Measures

We implement:

• Secure online      ordering platforms
• Encrypted      payment processing
• Password-protected      gallery access
• Limited      internal access to student data
• Secure storage      of digital files
• Controlled      access to administrative systems

8.3 Data Retention

• Student images      and associated order information may be retained for archive and reorder      purposes.
• Data is      retained only as long as reasonably necessary for business and legal      purposes.
• Upon written      request, we will make reasonable efforts to remove personal information      where legally permissible.

8.4 Third-Party Service Providers

We may use third-party vendors for:

• Payment      processing
• Online      galleries
• Print      fulfillment
• Data hosting

These vendors are contractually required to maintain reasonable security safeguards.

8.5 Compliance with Student Privacy Laws

When working with schools, we strive to operate in alignment with applicable student privacy laws, including but not limited to:

• Family      Educational Rights and Privacy Act (FERPA), where applicable
• Children’s      Online Privacy Protection Act (COPPA), where applicable
• State-level      student data protection regulations

Schools remain the custodians of official educational records.

9. Image Delivery

• Digital images      are delivered through secure online galleries.
• Access links      are for the intended recipient only.
• We are not      responsible for unauthorized access resulting from clients sharing gallery      links.

Delivery timelines are estimates and may vary during peak seasons.

10. Cancellations and Rescheduling

10.1 By Client

Deposits (if applicable) are non-refundable unless otherwise agreed in writing.

10.2 By Company

We reserve the right to reschedule sessions due to:

• Weather      conditions
• Illness
• Equipment      failure
• School or      league schedule changes
• Safety concerns

11. Limitation of Liability

To the fullest extent permitted by law:

• Our liability      is limited to the amount paid for services.
• We are not      responsible for missed images due to absence, non-cooperation, uniform      issues, data errors or schedule changes.
• We are not      liable for data breaches caused by third-party criminal acts despite      reasonable security measures.

12. Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control, including:

• Natural      disasters
• Government      actions
• School closures
• Power outages
• Internet      service disruptions

13. Website Use Restrictions

Users may not:

• Attempt      unauthorized access to student galleries
• Use automated      tools to scrape images
• Share secure      access credentials
• Reproduce      website content without permission

Violations may result in account termination and legal action.

14. Governing Law

These Terms are governed by the laws of the State/Province of business.

15. Modifications to Terms

We may update these Terms at any time. Continued use of our website or services constitutes acceptance of the updated Terms.
